Comedian Kunal Kamra, Association of Indian Magazines and the Editors Guild of India filed a writ petition before the Bombay High Court regarding the constitutionality of the IT Rules, 2023. These rules direct the social media intermediaries to remove any content that is related to the Central Government and is deemed ‘fake, false, or misleading’ by a Fact-Checking Unit (FCU) established by the Government. The Petitioners are aggrieved as it makes the Government to be the sole arbiter of truth in respect of any matters related to itself. The Union filed in its reply affidavit claimed that Rules were issued in ‘public interest’.
