The Criminal Procedure (Identification) Act, 2022 was passed in April 2022. The Bill enhances the powers of enforcement agencies regarding collection of data related to a person during investigation. Pertinently, it has broadened the scope terms like measurement to include iris and retina scan, physical and biological samples etc. The article highlights the issues arising from enactment of the law such as violation of international human rights conventions, ambiguity in drafting, violation of privacy and risks of widespread surveillance. The article also conducts a comparative analysis with other jurisdictions.
