SFLC.in’s Comments on the draft ‘Regulations for Use of Artificial Intelligence (AI) in Courts, 2026’

On 3 June 2026, the Supreme Court of India published the draft ‘Regulations for Use of Artificial Intelligence (AI) in Courts, 2026,’ prepared under the aegis of its Artificial Intelligence Committee, while inviting comments and suggestions from all stakeholders, including the general public. The Draft Regulations seek to establish a comprehensive framework governing the adoption, deployment, and oversight of AI systems across the Indian judiciary, including the Supreme Court, High Courts, subordinate courts, tribunals, and other statutory bodies performing adjudicatory functions.

On 15 July 2026, SFLC.in submitted its comments, welcoming the initiative to develop a comprehensive framework for the use of AI in the judiciary while highlighting several concerns that warrant careful consideration at the outset. These include inadequate safeguards for sensitive judicial data, the absence of a risk-based classification framework for AI systems, the potential for AI to exacerbate existing inequalities, and the lack of specific provisions requiring review mechanisms for AI system updates. The submission also recommends several improvements, including stronger protections for fundamental rights, enhanced transparency, independent oversight, clearer data governance standards, and a more robust risk-based approach to the deployment and governance of AI systems, among others.
