Comedian Kunal Kamra, the Association of Indian Magazines, and the Editors Guild of India filed a writ petition before the Bombay High Court challenging the constitutionality of the IT Rules, 2023, which allow the government to determine what constitutes ‘fake, false, or misleading’ content. The petitioners argued that this gives the government control over truth. In a split verdict, Justice Gautam Patel ruled against the rules, calling them a form of censorship and vague, while Justice Neela Gokhale upheld their constitutionality, stating they align with the public interest and democratic access to authentic information. The matter will now be decided by the Chief Justice of the Bombay High Court.
